What is this case about?

The Office of the Attorney General for the District of Columbia reached a settlement with Manganaro MidAtlantic LLC, over allegations that the company violated District of Columbia wage-and-hour-laws by misclassifying subcontracted workers as independent contractors when they should have been classified as employees. When workers are misclassified as independent contractors, they are denied rights that are entitled to employees, such as minimum wage, overtime, and paid sick leave.

Who can file a claim form?

If you are a construction worker who installed drywall on a Manganaro project in Washington, D.C. at any time from July 1, 2018 to November 30, 2022, you may be eligible for a share of the settlement fund.

What does the Settlement provide?

Manganaro paid $575,000 to the District to resolve allegations that it misclassified drywall workers as independent contractors when they should have been classified as employees under the District’s Workplace Fraud Act. The District will use $345,000 of these funds to make payments to affected workers.

Manganaro also paid $230,000 in civil penalties to the District and will implement improved compliance measures.

How do I get a settlement payment?

To ask for a settlement payment, you must complete and submit a Claim Form online by December 4, 2023.

To be eligible for a settlement payment, you must certify that you worked for Manganaro or a Manganaro subcontractor, or that you worked on a Manganaro job site, in D.C. between July 1, 2018 and November 30, 2022.

The Claims Administrator will initially decide whether the information provided on a Claim Form is complete and valid.  Additional information may be requested from any claimant.  If the required information is not provided in the time required, the claim will be considered invalid and will not be paid.

When can I file a claim form?

You can file a claim form now through December 4, 2023.

How much will my settlement payment be?

We don’t yet know how much settlement payments will be. This will depend on the number of claims filed.
